These Terms govern your use of HomeScan AI operated by Modern Construction & Restoration LLC. By using the App, you agree to these Terms.
1. Eligibility
You must be at least 18 years old.
2. Account Registration
You are responsible for maintaining account security and all activity under your account.
3. Description of Service
HomeScan AI is an AI-powered diagnostic tool that analyzes photos of home issues to provide automated assessments.
4. AI-Generated Content Disclaimer
All assessments are for INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. They are NOT a substitute for professional inspection, engineering assessment, or licensed contractor evaluation. AI analysis is based solely on photographs and cannot detect hidden issues. Results may contain inaccuracies. Do NOT rely on this app for safety-critical decisions.
5. Subscription Plans
- Free: 3 scans per month.
- Pro ($4.99/month or $29.99/year): Unlimited scans, full history, shareable reports.
- Billed through Apple In-App Purchase. Auto-renews unless cancelled 24 hours before period end.
- Cancel anytime in Apple ID Account Settings. No partial refunds.
6. Acceptable Use
Do not use the App for unlawful purposes, upload illegal content, reverse engineer the App, circumvent limits, or use bots/automation.
7. Intellectual Property
The App and all associated IP belong to Modern Construction & Restoration LLC. You retain ownership of your photos and grant us a limited license to process them.
8. Limitation of Liability
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF AMOUNTS PAID IN THE PRIOR 12 MONTHS OR $100. WE ARE NOT LIABLE FOR PROPERTY DAMAGE, PERSONAL INJURY, OR FINANCIAL LOSS FROM ACTIONS BASED ON APP RESULTS.
9. Indemnification
You agree to indemnify and hold harmless Modern Construction & Restoration LLC from claims arising from your use of the App.
10. Dispute Resolution
Governed by Arizona law. Disputes resolved by binding arbitration in Maricopa County, Arizona. Class action waiver applies.
11. Termination
We may suspend or terminate accounts for Terms violations.
12. Modifications
We may update these Terms with notice. Continued use constitutes acceptance.
